PEER-TO-PEER SOFTWARE USER ADVISORY

Copyright Infringement Liability. Peer-to-peer (also know as “P2P”) technology
makes it possible to share all kinds of information. Some information, including popular
music, movies, games and software, is protected by copyright. As a result, with limited
exceptions you must have the copyright owner’s permission before you make the work
available to other peer-to-peer users.

Copyright infringement can result in significant monetary damages, fines and even
criminal penalties. The means by which copyright owners protect their rights is through civil
lawsuits. You can learn more about copyright laws at the U.S. Copyright Office website:
http://www.copyright.gov/title17

Data Security
. Peer-to-peer software allows users to share information with other users
worldwide. Users can view the contents of each others’ shared folders, including any personal,
confidential, financial, or medical information. This information might be used to cause you harm,
and may lead to identity theft (for more information on identity theft, please consult this website:
http://www.ftc.gov/bcp/edu/microsites/idtheft/ ). You should pay careful attention to any
information you leave open to peer-to-peer access.

Unwanted Exposure to Pornography
. Peer-to-peer software may give users access to
pornography, which may be mistitled to attract users, including children. The distribution and
possession of illegal pornography, particularly child pornography, is a serious crime, and may lead
to criminal prosecution. Ility believes strongly that we all must stamp out child pornography.

Download Security
. By opening or downloading a file, you may expose your computer to
software called “spyware,” which can track your internet activities and report them to another
person or group. Similarly, such files may contain a Trojan horse, worms, virus or other malware.
Although AudioVine attempts to ensure that all files available through the Site are risk-free, there
are no guarantees. Your best protection is to keep all anti-virus software and spyware protection
software up to date.

Close your Connection. In some instances, closing the file-sharing program window does not
actually close your connection to the network. That allows file-sharing to continue and could increase
your security risk. If you have a high-speed or “broadband” connection to the Internet, you stay
connected to the Internet unless you turn off the computer or disconnect your Internet service. These
“always on” connections may allow others to copy your shared files at any time. What’s more, some
file-sharing programs automatically open every time you turn on your computer. As a preventive
measure, you may want to adjust the file-sharing program’s controls to prevent the file-sharing
program from automatically opening. For more information, Ility recommends that you consult the
Federal Government’s website at http://onguardonline.gov/index.html.
